Public play

Playing where others are present is not the same as playing where others are present without being asked, and that difference is exactly what the law watches.

What is public play?

Public play is BDSM or sexual play with other people present: at a play party, in a club, or outdoors. Those present watch and do not join in. Of all the forms in this list, this is the only one where the answer to “is this allowed” depends on the place, not on the act.

How public play looks in practice

By far the most public play happens indoors, on an evening where everyone knew where they were going. That is exactly why it works.

A typical evening looks like this. You come into a room with a bar, a changing area, and a play space. There stand a St Andrew’s cross and a spanking bench; one scene is going and four people watch from a distance. No one talks, no one walks through the middle, and a dungeon monitor works the edge. Afterward no one claps.

Outdoors is a different matter, and the law is only part of it. There is no audience that chose to be there and there is no supervision. Anyone who still wants it outdoors picks the margin in practice: a walled garden, a private plot. That is not the same as a park.

How common it is has been counted well, once. Jennifer Rehor put 126 acts to 1,580 women from the kink community and published the results in Archives of Sexual Behavior. Across the whole group, 32.15 percent had had sex in public at some point. Within the subgroup with an interest in being watched, that was 57.27 percent.

Where the line between public and private falls

Not at the number of people watching, but at the question of whether they could have stayed away. Dutch law draws that line in two pieces. Article 254b of the Criminal Code penalizes acts that are offensive to public decency, and it does so in two places at once: in public, and in a non-public place where someone is present against their will. That second piece is exactly why a club is no safe haven and why house rules exist: it is the presence against someone’s will that makes it punishable, not the building.

Outdoors there is a further provision that few people know. Article 430a fines being unclothed on or beside a place meant for public traffic, outside the spots the municipal council has designated for it. So nothing sexual has to happen for there already to be an offense.

And private does not automatically mean out of sight. The encyclopedia entry on public sex also counts a private place that is visible from public ground: a balcony, a back garden, a bedroom with the curtains open. It is about the view from outside, not about the wall.

Why people play in public

For the watching, from both sides. That sounds like one reason but it is two, and they rarely come from the same person.

  • For the one being watched, the payoff is that there is nothing left to hide. Rehor found that 56.14 percent of her participants did something around being watched, which makes it a majority experience rather than a curiosity.
  • For the one watching, it turns out to be even more ordinary. In that same study, 86.46 percent of the 1,580 women reported that they enjoyed watching one or more of the acts they were asked about.
  • For two people together, something shifts in the play itself: there is a reason to do it well, and a reason to agree on what does not happen.

An audience also steers. Anyone who notices they are being watched plays on easily past the point where they would otherwise have stopped, and that effect is strongest the first time.

What public play is not

“Public play is the same as exhibitionism.” No. With exhibitionism the arousal sits in the showing itself, often precisely to someone who did not ask for it. With public play the audience is the setting, not the goal, and that audience has chosen to be present.

“In a club anything goes.” Also no. In a private place the law looks at whether anyone is present against their will, and the venue’s house rules do the rest. A DM steps in at what the venue does not want to see, even if the two players agreed between themselves.

“If no one complains, there is nothing wrong.” With play outdoors that is a bet on whether there are witnesses, not on the text of the law. And the people who come across such a scene by chance signed up for nothing.

What I see myself

I’m Victor, gigolo, in the BDSM world since 1990 and trained as a psychotherapist. Of all the wishes people bring me, this is the one where the first time most often disappoints, and that is rarely down to the scene.

People prepare for being seen and not for the rest of the evening. That you are still in the same room two hours later, that someone at the bar strikes up a conversation about what he saw. That part lands harder than the scene.

The second thing is that an audience takes the brake off, on the side of the one steering just as much as on the other side. That is why, for an evening with an audience, I agree a tighter plan than for at home, not a looser one.

What you can do yourself

  • Go and watch once without playing. At a play party watching is a valid role, and one evening on the sideline teaches you more about the atmosphere than ten descriptions.
  • Read the house rules before you go in and ask at the door what is not allowed here; that differs from venue to venue and from evening to evening.
  • Agree a tighter plan than at home, with an endpoint in acts and not in time, precisely because an audience makes you want to go on.
  • Agree who handles contact with bystanders, so that does not land on the receiving side.
  • Play outdoors only on private ground you have permission for, and count on the fact that anything visible from the street counts legally as in public.
  • Arrange your aftercare in advance, because the place you normally sink into is not there at a party and the venue runs on.

  • Pick-up play. What happens when two people met only moments earlier at such an evening.
  • Exhibitionism. The form where being watched is the goal itself, and where the law looks at it differently.
